These Terms of Service (“Terms”) govern your use of Garahe (https://www.garahe.store), a curated online marketplace for used cars in the Philippines, operated by Philippe Mathew (“we”, “us”, or “Garahe”). By creating an account or using Garahe, you agree to these Terms.

Garahe is a curated marketplace. We help buyers discover listings and help sellers present cars after our review process. We are not a car dealer, broker of record, escrow agent, or party to any sale between a buyer and a seller. Any purchase, payment, inspection, transfer of ownership, or registration is strictly between the buyer and the seller.

You must be at least 18 years old and able to form a binding contract under the laws of the Republic of the Philippines to use Garahe. If you use Garahe on behalf of a business, you represent that you have authority to bind that business.

You may sign in with a supported identity provider (such as Google) through our authentication partner. You are responsible for activity under your account and for keeping your login credentials secure. Provide accurate information and keep it up to date. We may suspend or terminate accounts that violate these Terms or that we reasonably believe put users at risk.

Sellers may submit listings, photos, and details for review. We may approve, reject, edit for clarity, or remove listings at our discretion to keep the marketplace trustworthy. Hand-review is a quality filter, not a warranty. We do not guarantee that any car is free of defects, flood damage, liens, odometer issues, or title problems, or that seller statements are complete or accurate. Always inspect vehicles and verify papers yourself (or with a trusted mechanic / counsel) before paying or transferring ownership.

If you list a vehicle, you represent that you have the right to sell it (or are authorized by the owner), that your photos and descriptions are not knowingly misleading, and that you will comply with applicable Philippine laws. You must not list stolen, encumbered-without-disclosure, or otherwise unlawful vehicles. You are solely responsible for negotiations, payments, delivery, and transfer with buyers.

Listings and contact details are provided so you can evaluate cars and contact sellers. You are solely responsible for diligence before purchase, including inspection, paperwork, payment method, and ownership transfer. Do not rely solely on Garahe content when making purchase decisions.

We may reveal seller contact information to signed-in buyers subject to rate limits and abuse controls. Do not use contact details for spam, harassment, scams, or any unlawful purpose.

Garahe may offer parts of the service free of charge. We may introduce fees later; if we do, we will disclose them before you incur them. Any money exchanged for a vehicle is between buyer and seller — not processed by Garahe unless we expressly say otherwise in writing.

You may not: scrape or abuse the service; upload malware; impersonate others; post illegal or infringing content; attempt to bypass security or review controls; or use Garahe to facilitate fraud. We may remove content and restrict access to protect the marketplace and our users.

Garahe’s name, logo, and product design are ours. You keep ownership of content you upload (such as listing photos and descriptions) and grant us a non-exclusive, worldwide license to host, display, and distribute that content as needed to operate and promote the marketplace. You represent that you have the rights needed to grant that license.

Garahe is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free service, or that listings are accurate, complete, or current.

To the fullest extent permitted by law, Philippe Mathew and Garahe will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the service or from any transaction between users. Our total liability for any claim relating to the service is limited to the greater of (a) amounts you paid us for the service in the 12 months before the claim, or (b) PHP 2,000. Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent allowed.

You agree to defend and indemnify Philippe Mathew against claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of Garahe, or your dealings with other users, to the extent caused by you.

We may update these Terms from time to time. The “Effective” date above will change when we do. Continued use after changes means you accept the updated Terms. If you do not agree, stop using Garahe.

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict of law rules. Courts located in the Philippines shall have exclusive jurisdiction, except where applicable law requires otherwise.
